No, child care reimbursements are not part of the order of pay. The monthly child care election is deducted from your payroll pre-tax (similar to a 401K deduction). Therfore, a child care reimbursement can still be paid even if you are in a back pay backpay situation. There just need to be sufficient funds in the child care account to pay the reimbursement.
